Arfy Terms of Service
1. Who these Terms are between
These Terms are a contract between Pippa LLC ("we") and the adult who creates an Arfy account ("you"). You must be 18 or older and the parent or legal guardian of the child who uses Arfy on your phone. Children do not sign up, sign in or agree to anything. These Terms cover Arfy only.
2. What Arfy is, and is not
Arfy is a play app that helps kids aged 4 to 9 get curious about new foods, at their own pace.
Arfy is not medical care. It does not give medical or nutrition advice, and it does not diagnose, treat or monitor any condition. Arfy can't tell whether a child is eating enough. If you are worried about how your child eats or grows, please talk to your care team.
You decide what is safe. Arfy does not know your child's allergies, choking risks or any diet their care team has set. Choose the foods yourself, and stay with your child when they try something new.
3. Your account
Give a real email address and keep your password to yourself. Your password also opens the grown-up lock, so please do not share it with your child. You are responsible for what happens under your account. Your child should use Arfy with your permission and under your supervision.
4. Your content
You own what you and your child add to Arfy. You give Pippa LLC a limited, non-exclusive, revocable license to store and show it only to run Arfy for your family. We do not use it for advertising or to train AI models. Please keep people's faces out of plate photos. The license ends when the content is deleted.
5. Privacy
The Arfy Privacy Policy explains what we save, what stays on your phone, and your rights as a parent. It is part of these Terms.
6. Price
This version of Arfy is free. It has no ads, no in-app purchases and no subscriptions. If that ever changes, we will tell you first and you will decide whether to pay. A child will never be asked to buy anything.
7. Acceptable use
Please use Arfy only for your own family. Do not try to get into other people's accounts, scrape or reverse engineer the service, overload it, or use someone else's account.
8. Deleting your account
You can delete your account at any time. See Delete your account. We may suspend or close an account that breaks these Terms or puts the service at risk. You can also stop using Arfy at any time.
9. Changes to Arfy
We may change or stop parts of Arfy. It may be unavailable at times, and because it works offline first, entries may wait on your phone until it can reach our server. Plate photos exist only on your phone, so they are lost if the phone is lost, the app is removed, the account is deleted, or a different account signs in on that phone.
10. Disclaimer of warranties
ARFY IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR UNINTERRUPTED AVAILABILITY, TO THE EXTENT THE LAW ALLOWS.
11. Limitation of liability
TO THE MAXIMUM EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT ARFY IS LIMITED TO THE GREATER OF (A) WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $100, AND WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES. THESE LIMITS DO NOT APPLY TO GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR LIABILITY THAT CANNOT BE LIMITED BY LAW.
12. Indemnification
You will indemnify Pippa LLC against claims arising from your breach of these Terms, from misstating your age, identity or authority, or from misuse of your account.
13. Arbitration and class waiver
Disputes are resolved by binding individual arbitration under the AAA Consumer Arbitration Rules, not in court, except small-claims matters and where the law does not allow it. No class actions. You agree to this for yourself and on behalf of your child, where the law allows. You may opt out of arbitration within 30 days of agreeing by emailing pippa.app.general@gmail.com.
14. Changes to these Terms
We may update these Terms. For a material change, we will tell you in the app and ask you to agree again before you keep saving to our servers. Sections 2, 4, 8 and 10 to 15 survive the end of these Terms.
15. General
If part of these Terms is unenforceable, it is limited as little as needed and the rest stands. These Terms and the Arfy Privacy Policy are the whole agreement about Arfy. You may not transfer your account. Apple and Google are not parties to these Terms and are not responsible for Arfy, but Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
